So you probably recognize housing sharing by its more common name such as Airbnb or HomeAway housing sharing rentals are short-term rentals that are otherwise private residences. The popularity of these rentals, especially in large cities like Chicago, have created the need for tighter regulations. First off, you must register your unit with the city of Chicago as one of three categories: shared housing, unit vacation rental, or bed and breakfast. In Chicago, shared housing units are defined as having six or fewer sleeping rooms with a portion of the property being rented for transient occupancy. A vacation rental is described similarly, but the entire property is for rent.

How to Sublet Legally in Chicago Read your lease carefully. Get pre-approval to sublet. Find and screen a subletter. Send a written request for approval. Wait patiently (but not too patiently) Collect and store a security deposit and/or the first month of rent. Be free and go somewhere better!
Illinois has reasonable laws regarding rental properties. If you are in Chicago, the climate does switch to a more tenant friendly situation with regard to the law.
If you both plan to move out of the apartment and you have to break the lease youll likely lose the security deposit. If you both paid half then theres no problem. But if one person paid the entire deposit, the other person should reimburse them half of what was lost.
In most cases, your landlord cant stop you from subleasing a Chicago apartment, so long as you find a subtenant who meets the landlords reasonable requirements. Chicagos Residential Landlord Tenant Ordinance (CRLTO) requires landlords to accept a reasonable sublease without an additional fee (Section 5-12-120).
As far as painting, unless the paint is peeling or overly damaged, you may not be required to paint. Many landlords allow their tenants to paint for them, provided they repaint it back to a neutral shade upon move-out. Its up to you how you want to manage painting.
But in Chicago, subletting is always legalno matter what the lease says. A sublet (or sublease, as its also called) is an agreement where a current tenant rents out their apartment to another person, who becomes their subtenant. Across most of Illinois, a tenants right to sublet depends heavily on their lease.
In Chicago, standard lease agreements include the following attached documents: Chicago Residential Landlord Tenant Ordinance Summary; Security Deposit Interest Rate Summary; Heating Cost Disclosure Statement; Lead-Based Paint Disclosure and Pamphlet; Radon Hazard Disclosure; and a Move-in/Move-out Checklist.
In Illinois, there is no law requiring landlords to allow sublets. But your lease may address it, so you should read that first. Also, local laws may require your landlord to allow sublets.
