[Music] todays murphy law monday i just want to briefly touch on the topic of what to do when you have a custody arrangement kind of already in place but you want to change it and when i say kind of i mean lets say you and your ex lover made an agreement when the child was three that you would get every other weekend and mondays and tuesday dinners um but now you want more time with your son and now hes eight this is a situation where there may be a case for a modification and you would need to hire an attorney to be able to tell you and explain to you what would be required to show a modification dont just unilaterally change the agreement on your own that is something that the courts do not like especially after youve been served with papers if youre in need of legal services in the state of maryland or the district of columbia please contact my office 240-493-9116 thank you

There is no court form available to terminate parental rights. You will need to draft the required pleading either on your own or with the assistance of a private attorney. Generally, Family Code section 7820 covers termination of parental rights.
How Do I Request Modification? Making a request only requires you to submit one form: Form FL-300, the Request For Order. Once filed with a court, the process will begin in earnest. You may also file Form FL-311, Child Custody, and Visitation, though this is optional.
Situations that Warrant Termination of Parental Rights If the parent has not exercised his or her parental rights in at least six months, that is also grounds to have parental rights terminated in California. California law provides several reasons that termination of parental rights may be appropriate.
Abandonment. If a parent has not had any contact with their child in at least six months and has made no effort to contact the child or exercise their parental rights, the court will consider this abandonment.
Essentially, if a parent left their child with a non-parent for at least six months or with the childs other parent for at least a year without child support or contact, that constitutes child abandonment.
Under California Family Code section 7822(a)(2) and (a)(3), you must show that one or both parents had the intent to abandon the child. You can show that there was intent to abandon the child by the legal parent, or parents, by using the surrounding facts of your case.
To do this you may: (1) obtain the services of an attorney to handle your case; or (2) file the case yourself by using the Domestic Relations forms. Use this form only if there is already a court order for custody or visitation AND you were named as a plaintiff or defendant in that court case.
If you and your co-parent cannot agree about your custody arrangement, you can petition the court for a change. To do so, you must prepare a schedule you think is in your childs best interests. You will also need to fill out an official petition to modify custody from with the court that initially handled your case.
