If you are not behind in your rent but the landlord wants you to move out, they must give you a written notice. Only a 30-day notice is required if all tenants have lived there less than a year. A 60-day notice is required if all tenants have lived there a year or longer.
When responding to the notice to quit, there are several options available to the tenant: Pay any delinquent rent that is due to the landlord within the allotted time of the notice. Move out of the premises within the allotted time of the notice. File an answer with the judicial court. File a motion to stay with the court.
If the tenant does not pay the rent within 3 days of receiving the 3-day period, he or she must still move out in 30 days. If the tenant does not move out after the 30 days, then the landlord has to file an unlawful detainer case.
A notice to quit is a document from the tenant to the landlord notifying them that they are leaving the rented premises. A notice to quit must be in writing and provide: the right amount of notice, setting out the date the notice period ends. the address of the premises.
If tenants dont leave at the end of the notice period, landlords must apply to the court for a possession order, which gives them the right to evict tenants and take possession of the property.
You cannot withdraw a valid notice if you change your mind. Your landlord may agree to let you or other joint tenants stay on after a notice ends.
A notice to quit served by a landlord during the fixed-term of a tenancy will be invalid. It does not end the tenancy even if the notice period expires after the expiry of the fixed term. The exception is if the tenancy agreement contains a break clause that allows for early termination.
