Right, you wanna terminate a contract right. Now, the reason I said Eek is because it is one of the areas of law where you really are exposed if you get it wrong. So lets just step back. How do you terminate a contract? The key thing in terminating the contract is to look at the actual contract and examine the termination clause. Now most of those sorts of clauses, because weve seen hundreds, most of those clauses will set out a process of things you have to do. Usually you have to provide notice, one in writing and of a certain time period, 30, 60, 90 days of notice. These laws vary from state to state. In general, the law requires that individuals must give their permission before their name or likeness can be used for a commercial purpose.
If you did not sign a release to use your photograph then your former employer has no right to use it. You may have a claim for misappropriation of your likeness. It appears they are using you image for a commercial purpose.
This is called commercial misappropriation. So the company owns the image, and unless you signed a release of your rights completely, you can demand they take it down. You may want to consider just writing a cease and desist letter.
This situation can qualify as an invasion of privacy, and you may have some legal remedies and gain control of the image. Right of publicity. Someone can violate your right of publicity by using your photograph for commercial purposes without your consent.
