Under California Business and Professions Code Section 16600, unless you were an owner of the business, any non-compete clause which forbids an employees who is fired or resigns from working for a competitor or starting a competing business is illegal and unenforceable.
A non-compete clause is a contractual term between an employer and a worker that typically blocks the worker from working for a competing employer, or starting a competing business, within a certain geographic area and period of time after the workers employment ends.
Although non-compete agreements are unenforceable in California, confidentiality agreements are enforceable.
Generally speaking, you must either show that the terms of a non-compete are unenforceable or docHub a release agreement with other parties. It is unlawful for California employers to fire employees who refuse to sign non-compete agreements. When an employer terminates an employee on illegal grounds, a wrongful termination has occurred, and the employee may choose to take legal action against his or her employer.
