hi thanks for using my court coach im sarah and ill be your instructor today as we talk about the affidavit of facts constituting contempt for domestic violence and or custody and visitation this is also known as form fl412 as with all our court forms you want to fill in your identifying case caption information at the top this form is not a standalone form it would be attached to your order to show cause and affidavit for contempt form which is form fl 410 if you are seeking to have the court find that the other party is in contempt with contempts the important thing to remember and this is especially true when it comes to um the less black and white issues such as custody visitation or domestic violence you need to be very specific about what you are alleging with the financial issues if a party doesnt pay support thats pretty easy to show they either have proof that they paid it or they approve they dont pay it because custody visitation has so much gray area in it the more det

Although the law specifically permits children at least 14-years-old to express an opinion, there is no specific age when a judge will listen to a childs opinion. California statutes also permit a child younger than 14 years old to testify regarding a custodial preference, unless the court decides its not in the
In California, the law allows children age 14 and up to express their parental preference to aid in determining custody. However, no matter the childs age, a judge will consider their preference in evaluating the overall suitability of the custody arrangement.
The most common type of sole custody ordered by the Court in California is sole physical custody with joint legal custody and a generous visitation schedule for the non-custodial parent.
Under current California law, fathers have equal rights to not only have primary custody of a child, but to also petition for child support from the mother.
Generally, you can move with the children so long as the relocation doesnt interfere with your current custody arrangement. For courts, thats usually limited to a distance of 50 miles or less. (However, even a move 30 miles away could be disruptive depending on the circumstances.)
California parenting plans must contain information about physical and legal custody. Physical custody is where your child lives and who cares for them. You should specify whether one parent will have sole physical custody or the parents will share joint physical custody.
You must give the other parent (and their lawyer) written notice of your plans to move at least 45 days before the day you plan to move. A parent can only move a certain distance away without the other parents written agreement that is agreed by the court.
This is known as the parents earning capacity. In certain situations, even though a parent has no income, the court will order him or her to pay child support based on his or her earning capacity. A court may also require a parent to attend job training, job placement, or other work programs.
