The LTB does not cover issues between a landlord and a tenant before a lease begins. However, if a landlord and tenant sign a lease and the landlord collects a rent deposit from a tenant but then does not allow the tenant to move in, the landlord must return the tenants rent deposit.
Security deposits, legal or not in Ontario? No, security deposits (damage deposits as theyre also known) are illegal in Ontario. If a tenant damages something and you want them to pay to replace or fix it, you must ask them for money that is separate from their rental deposit.
Receipts for security deposits should generally include the tenants name, the location of the bank holding the security deposit, the account number (if legally required), the amount deposited, the date, your name, and your signature.
