An Arkansas small estate affidavit is used to collect the personal property of a person who died in situations where the person had an estate valued at less than $100,000. It cannot be filed until 45 days have elapsed since the death of the decedent.
You must file an Affidavit for Collection of Small Estate with the probate clerk of the circuit court in the county where the deceased last lived. The affidavit can be filed by one or more of the people receiving proceeds from the estate (called distributees).
Probate Code 13100 13115 provide for a summary procedure to transfer the personal property of a decedent without going through a probate action if the decedents estate is valued at less than $150,000 and at least forty (40) days have elapsed since the death of the decedent.
