An expungement only applies to those found innocent or not convicted. An expungement does not apply to those who have been convicted of a crime, unless the conviction is later overturned or an absolute pardon is granted. Absolute pardons are granted only in rare cases by the governor.
The filing fee is $30 for eligible guilty dispositions and is nonrefundable, even if denied. The fee is for each case (not for each charge related within a unit of the case). If you cannot afford the fee, you may request that the court waive the filing fee.
In 2021, Virginia enacted legislation that allows criminal convictions to be sealed from public view. This is different than expungement because expungement is only for non-convictions (acquittals and dismissed charges).
Clean Slate Virginia uses new Virginia sealing laws and existing expungement laws to clear criminal records throughout the entire state of Virginia. When criminal convictions are sealed, they cannot be seen by the public or employers.
Misdemeanor conviction records may be automatically sealed seven years after a conviction as long as specific criteria are met. First, you must not be convicted of a separate crime that is ineligible for automatic expungement at the same time as the misdemeanor.
The current expungement process in Virginia requires the individual charged with the offense to file a petition and fingerprints with the circuit court, pay a filing fee, and possibly attend a hearing on the matter.
