Fortunately, there is not a deadline of any sort for creating a postnuptial agreement. While it is typically recommended to draft one soon after marriage, it can spouses can initiate an agreement at any point during the marriage.

In California, you can write your own postnuptial agreement, but this option is not recommended. These agreements must meet numerous legal requirements to be considered valid and enforceable by law, and most non-legal professionals simply do not possess the knowledge and resources to draft a sufficient agreement.
A prenup is more likely to be enforceable than a postnup if one of the signers attempts to dispute it following dissolution of the union. Divorce courts tend to presume that coercion is less likely when independent people are signing before they are actually married and have mixed their assets.
A postnuptial agreement cannot provide enforceable terms for child support or custody. However, it can include provisions for alimony since that is considered separately from a spouses duties as a parent.
For example, a house bought after a couple gets married is marital property, while a car bought before marriage is separate property. These postnup clauses offer a guide for dividing the couples joint property without emotions or outside influences getting in the way after the marriage ends.
