Your rights as a tenant include: not having the landlord enter the property without prior notice and approval, the right to dispute the lease agreement, and. the right to give notice and terminate the lease before it expires (which might lead to penalty costs).
Section 5 of the Rental Housing Act, No 50 of 1999 allows a landlord to take a deposit from a tenant prior to the tenant moving into the property. The amount of the deposit must be stipulated in the lease agreement. It is conventional practice to pay an amount equal to one-months rent as a deposit.
During these blackout dates, the vacation rental may not be available for rental or may only be available at a premium price due to the high demand for lodging during these peak periods. Blackout dates can include major holidays, local festivals or events, and other popular travel periods.
Section 14(2) of the CPA provides that a tenant must give 20 business days written notice to the landlord of their intention to terminate the lease agreement. The tenant remains liable for any amounts owed to the landlord in terms of the lease agreement up to the date of cancellation.
Both the landlord and tenant must give at least one months notice to the other party when wanting to cancel the lease. (See Rental Housing Act 1999.) The Consumer Protection Act (CPA) gives additional rights to the tenant by allowing them to cancel the lease provided 20 business days notice is given.
The Constitution provides that no persons property may be taken away from him/her and that no person may be evicted from his/her home without a court order. This means that an owner or a person in charge of a property (landlord), must apply to court before evicting a person (tenant) from his/her property.
Landlords are not allowed to enter the property without the tenants permission, unless it is in an emergency situation. Even in the case of an emergency, the landlord must still give the tenant reasonable notice before entering the property.
