Commonly Asked Questions about US Marriage Legal Documents

The United States has no national registration of marriages, foreign or domestic. U.S. states recognize marriages performed in other states and in other countries. If your marriage was legally performed in the country or state where you got married, then the marriage is recognized in the United States.
The basic elements of a marriage are: (1) the parties legal ability to marry each other, (2) mutual consent of the parties, and (3) a marriage contract as required by law. See also Common-Law Marriage.
The marriage certificate is the official document issued by the county/state attesting a couple is legally married, says Smith-Hoban.

A trip to your countys clerk office with this paperwork in hand will secure you a marriage license (but be sure to check the specific requirements for your county first).
Examples of acceptable forms of Identification include, Drivers license or State Identification, Passport, Military I.D., Consulate Card. A certified copy of a birth certificate or court ordered name change will also need to be provided if photo identification does not contain full name.
Typically, youll both need valid government-issued photo IDs (drivers licenses or passports) and proof of Social Security numbers. If either of you has been married before, youll likely need certified copies of divorce decrees or death certificates (if a spouse has passed away).
