Kentuckys disclosure laws require sellers of residential property to disclose to prospective buyers certain defects with their home that could reduce its market value. If selling a home in the Bluegrass State, youll need to be mindful of Kentuckys disclosure requirements.
The answer is only residential properties. Most seller property disclosures are required for only residential properties.
Effective March 20, 2024, the amended New York Real Property Law Chapter 50, Article 14 (the Property Condition Disclosure Act) will compel all sellers of residential property to complete and deliver a Property Condition Disclosure Statement (PCDS) to a buyer prior to signing a contract of sale.
The Kentucky Revised Statutes 324.360 states that sellers are obliged to make certain property disclosure to the buyer prior to the sale. Its a four-page form that has series of questions that can be responded with N/A, Yes, No, and Unknown, and provide an explanation to add details about the defects.
The Seller Disclosure of Property Condition applies to all sales and purchases of residential real estate in Kentucky, except for in the case of a court supervised foreclosure, a sale of real estate at auction or residential purchases of new homes if a warranty is offered.
Kentucky Death Disclosure Kentucky does not require disclosure of death on a property. If a buyer ask, however, the seller and agent must be truthful.
