Unlawful detainer actions require a landlord to provide you with a three days written notice to vacate. If you do not leave, the landlord can sue by filing a complaint against you in court. After you receive a summons to appear in court, you have five days to object in writing to the eviction.
Arkansas tenants have the right to seek a rental unit without being discriminated against by their landlord. On the other hand, tenant rights allow them to report any safety or health violations to the local authorities.
In Arkansas, there are no state laws that limit the amount by which a landlord can increase rent. Landlords have the freedom to raise the rent by any amount. However, they must provide tenants with a 30-day written notice before the rent increase takes effect, especially in month-to-month tenancies.
Under 9-26-104, a minor is eligible for emancipation as early as at the age of 16. However, if a minor is involved in a neglect or dependency action, the minor must be at least 17 years of age, under 9-27-362.
Your landlord or manager retains the right to enter the property at reasonable times to inspect it or make repairs except he may enter any time in case of an emergency which would endanger property or people. Absent an emergency, the landlord should notify you before entering the property and ask your permission.
For non-payment of rent, this notice must give the tenant at least three days to vacate. For all other lease violations, the notice period should be at least 14 days. For termination of a month-to-month lease (absent some other lease violation), the notice period must be at least one month.
Landlords must give tenants a 30-day notice before requiring a month-to-month tenant to move out. For a week-to-week lease, only a seven-day notice is required.
The landlord must file a case in circuit court to get a court order to evict the tenant. Tenants may qualify for free legal aid from the Center for Arkansas Legal Services or Legal Aid of Arkansas.
