How long can I have off work after a bereavement? There is no set legal amount of time off work you are entitled to after someone has died. It is common for employers to give about three to five days, but all organisations have different policies and/or exercise their discretion differently.
Bereavement. Leave. California law guarantees most employees up to five days of bereavement leave from work following the death of a family member.
California law does not require that your five days of bereavement leave be paid. However, you are free to use your paid vacation and sick days for bereavement purposes. Prior to this new law, many California companies already offered bereavement leave and some of these policies are paid.
Time off for a funeral This time off might be called compassionate leave or special leave. In all circumstances theres no legal right for this time off to be paid, but some employers might offer pay. Employers and employees should check the employees contract or organisations policy.
A qualifying family member includes a spouse, child, parent, sibling, grandparent, grandchild, domestic partner, or parent-in-law. An employee may take the five days of bereavement leave consecutively or intermittently. However, the leave must be completed within three months of the date of death of the family member.
