CENTRAL CALIFORNIA APPELLATE PROGRAM. Handling Peoples Appeals and Cross Appeals. A Peoples appeal is one in which only the prosecution has filed a notice of appeal, and as such, it is the sole appellant. In contrast, a cross appeal is one in which both parties have filed a notice of appeal.
Cross-objections can be filed within one month from the date of service on the respondent or his pleader of the notice of the date fixed for hearing of the appeal. [R. 22(1).] The appellate court may, at its discretion, extend the period within which cross-objections can be filed.
(b) A cross-appeal is taken by timely filing a notice of cross-appeal in accordance with rule 10(1) of these rules in the office of the clerk of the supreme court substantially complying with Form 2 in the Appendix of Forms, along with the filing fee prescribed by statute or the affidavit to proceed without advance
