This is a direct violation of HIPAA, and dental practices with any policy limiting or creating a barrier to the patients access to their records could lead to a steep fine.
HIPAA also gives patients the right to obtain copies of their complete dental records including radiographs and photographs from a covered dental practice, and state law may give patients this right as well.
The dentist owns the physical record of the patient and is the legal guardian of the chart and its complete contents, including radiographs. While patients do not have the right to possess their original record, they do have the right to see, review, and inspect their record, and to request and obtain a copy of it.
The good news is that most dentists have no issues doing this since you are legally entitled to a copy. However, you may have to sign in a form or call in to authorize a request to release your x-rays. Fortunately, this service is typically free of charge.
