Upon the approval of the K-1 visa petition filed by the US Citizen petitioner, a dependent child of a K1 fiance can apply for a K-2 Visa at a US Embassy simultaneously at the same time as the k-1 visa applicant parent or a subsequent future date.
Eligibility The sponsoring fianc(e) must be a U.S. citizen. Both parties must have the intention to marry within 90 days of the non-U.S. citizens arrival in the United States. Both fianc(e)s must be legally permitted to marry, meaning all previous marriages have been terminated.
The K-1 fianc(e) visa is for foreigners who wish to marry a U.S. citizen in the United States and become legal permanent residents (LPR) without leaving the United States. K-2 visas are for the children of K-1 applicants. A K-2 applicant must be under the age of 21.
The Consular Officer may require additional information to determine whether you qualify for a visa. If you need to submit additional information, your visa will be refused under section 221(g) of the Immigration and Nationality Act. This does not mean the visa has been refused permanently.
