What is my residency status for tax purposes? Having an H-1B Visa does not mean youre required to file U.S. taxes. You are considered a U.S. resident for tax purposes only if you meet the substantial presence test for the calendar year, beginning on the first day you were in the United States.
As a general matter, under the U.S. Internal Revenue Code (Code), all U.S. citizens and U.S. residents are treated as U.S. tax residents. In order for a non-U.S. citizen (alien individual) to be treated as a resident alien, he or she must satisfy either the green card test or the substantial presence test.
H-1B aliens who are U.S. resident aliens for the entire taxable year must report their entire worldwide income on Form 1040, U.S. Individual Income Tax Return, in the same manner as if they were U.S. citizens. If they also paid foreign income tax on foreign-source income, they may be eligible for foreign tax credits.
An H1B visa holder can be considered a resident alien if they meet the IRS Substantial Presence Test, which determines if they have been in the US long enough to qualify as a resident for tax purposes.
