In addition to submitting Form AP-193, Texas Application for Retailer Cigarette, Cigar and/or Tobacco Products Taxes Permit (PDF), a retailer must have an active sales tax permit (Form AP-201, Texas Application (PDF)) for each commercial business location.
Rates. For a conventional package of 20 cigarettes, the tax is $1.41 per pack. For a package of 25 cigarettes, the tax is $1.7625 per pack. ($70.50 per 1,000 cigarettes weighing three pounds or less per 1,000.
$180 permit fee for the retailer permit is prorated over a two year permit period. New retailer permits are valid from the date of issuance through May 31 of each even numbered year. Renewals are valid for two years, beginning June 1 of each even numbered year and expiring on May 31 of each even numbered year.
