Qualifications for agricultural tax exemptions vary from state to state, too. Some states base eligibility on the size of the property, while others set a minimum dollar amount for agricultural sales of goods produced on the property. Many use a combination of gross sales and acreage requirements.
Under MCL 324.3601, certain farmland in Michigan may be enrolled in a development rights program by which the owner may receive state income tax credits for property taxes paid. To be eligible, the farm must be at least five acres in size and 51% or more of the property must be committed to an agricultural use.
What qualifies as ag exemption? To qualify, the land must have been used for agricultural purposes for at least 5 of the last 7 years, and it must be in ag use currently. Agricultural purposes include crop and livestock production, beekeeping and similar activities. Many counties have minimum acreage requirements.
New Structures Land Improvements A structure shall not be built on the land except for use consistent with farm operations, which includes a residence for an individual essential to the operation of the farm. Land improvements shall not be made except for uses consistent with farm operations.
Public Act 260 PA 260 protects the taxable value on farmland from rising to the State Equalized Value (SEV) when farm property is transferred, so long as the land remains an agricultural use.
