Use Form 709 to report: Transfers subject to the federal gift and certain generation-skipping transfer (GST) taxes.
When an insured person or policy owner dies and an estate tax return is filed (or when a life insurance policy is transferred as a gift), Uncle Sam wants to know about it by way of the Internal Revenue Service (IRS) Federal Form 712 Life Insurance Statement.
In prior years, it had been one of three forms (1040 [the Long Form], 1040A [the Short Form] and 1040EZ see below for explanations of each) used for such returns. The first Form 1040 was published for use for the tax years 1913, 1914, and 1915.
In 2015, any person can give any other person $14,000 without the gift being taxable. This is the same as 2014. There is also a onetime aggregate gift exclusion amount that is equal to the estate tax exclusion of $5,430,000 in 2015.
Unless exempt under section 501, all domestic corporations (including corporations in bankruptcy) must file an income tax return whether or not they have taxable income. Domestic corporations must file Form 1120, unless they are required, or elect to file a special return.

Use Form 709 only to report those transfers where the ETIP closed due to something other than the donors death. (If the ETIP closed as the result of the donors death, report the transfer on Form 706, United States Estate (and Generation-Skipping Transfer) Tax Return.)
List all reportable gifts made during the calendar year on one Form 709. This means you must file a separate return for each calendar year a reportable gift is given (for example, a gift given in 2015 must be reported on a 2015 Form 709). Do not file more than one Form 709 for any one calendar year.
