When is a response to an OPRA request due? Generally: As soon as possible. But no later than seven (7) business days after custodians receipt of the request. There should be another employee designated to receive/fulfill requests in the custodians extended absence.
OPRA is used when the requestor wants to gain access to government records and wants to invoke the OPRA statute, which provides a statutory right of access to government records and holds a records custodian to a response deadline.
A valid OPRA request is a written request to a custodian of a government record for access to an identified government record. N.J.S.A. 47:1A5(g). Requests for information or requests that ask questions are not valid OPRA requests. Requestors must be as specific as possible when requesting records.
Paper copies of records cost $0.05 per letter-sized page and $0.07 per legal-sized page; however, the delivery and postage fees could be additional, depending on delivery type. If special equipment is needed to make the copies (e.g., for maps), the requester may be charged the actual cost of duplication.
