If you are an alien individual and you meet the closer connection exception to the substantial presence test, you must file Form 8840 with the IRS to establish your claim that you are a nonresident of the United States by reason of that exception.
If you are a foreign national who meets the requirements to be treated as a US tax resident but want to avoid this status, you may be able to use IRS Form 8840.
8840 Closer Connection Exemption Statement for Aliens Canadian residents who winter in the U.S. are technically subject to U.S. income tax if they exceed a specific number of days (based on a calculation on the form 8840) in the U.S. in any one year.
Note that the difference between form 8833 and form 8840 is that the latter does not require an accompanying US income tax return.
This form allows for a closer connection claim to Canada, resulting in an exemption from U.S. residency for tax purposes. Due Date: Form 8840 must be submitted to the IRS by June 15 of the year following the tax year in question (June 16, 2025 for the 2024 tax year).
