Papers are issued upon birth by the owners of the foal. They are then transferred to any sellers down the line. Without the original papers or getting the owners to file them, you have no proof your horse is a QH.
Ownership, therefore, depends upon other circumstantial evidence, such as a bill of sale. When buying or selling a horse one is ought to get a written confirmation that the horse has been sold and that title has transferred. A complete written sale agreement will provide for even more protection.
AQHA rules require horses over the age of 4 to be parentage verified before they can be registered. This can sometimes be a hindrance if one or both of the parents has not been DNA typed and no longer available to be tested. In some cases, it is not possible to get DNA from one or both of the horses parents.
Registration papers literally mean nothing in the event of a sale and are only, really, for identification of a horse. Theres no laws saying a horse has to be sold with papers or anything like that.
If you are a current AQHA or AQHYA member, the cost to transfer ownership is $40. If you are not a current member: Youth ownership transfer: $25 (membership) + $40 (transfer) = $65. General ownership transfer: $65 (membership) + $40 (transfer) = $105.
