In 1910, the National Conference of Commissioners on Uniform State Laws (NCCUSL) approved the Uniform Desertion and Non- Support Act. This model act made it a criminal offense to fail to support or to desert a wife and children.
In most situations, you can file for custody in the home state of the child. The home state is the state where the child has lived (with a parent or a person acting as a parent) for at least the last six consecutive months before a parent files for custody - however there are exceptions to this rule.
The petitioner is the individual who initiates or files a legal action. In the context of family law, a petitioner might be the spouse who files for divorce or the parent who seeks child custody or support. The petitioner sets the legal process in motion by presenting their case or claims to the court.
UCCJEA and UIFSA These uniform laws have been adopted by all fifty states and the District of Columbia. They provide a basis for deciding which court has the power to decide a child custody or child support dispute, as well as governing how one state should enforce an order issued by another state.
UIFSA allows states to reach across state lines for the establishment and enforcement of child support orders. The United States also has reciprocal agreements with some other countries, including Canada, Germany, England, and Australia. All states have a central registry to receive incoming UIFSA petitions.
