982.552 PHA denial or termination of assistance for family. (a) Action or inaction by family. (1) A PHA may deny assistance for an applicant or terminate assistance for a participant under the programs because of the familys action or failure to act as described in this section or 982.553.
In general, the familys income may not exceed 50% of the median income for the county or metropolitan area in which the family chooses to live. By law, a PHA must provide 75 percent of its voucher to applicants whose incomes do not exceed 30 percent of the area median income.
Determine if Youre Eligible Meet income limits specified by HUD (less than 50% of the median income for the county in which you live). Be a citizen or eligible immigrant. Be 18 years of age or older. Be a resident of the state of Georgia.
Your landlord is not required to participate in the program or accept the funds if they would rather evict you. If your landlord refuses to accept payment, you should document proof of that. You can then use the funds to secure other housing.
If your landlord refuses your rent, they cannot file an eviction against you for nonpayment. If the landlord does file against you, you will need to file an answer explaining to the court that you offered the full rent payment but it was refused.
