Form 843 is available in the 1040, 1120, 1120-S, 990, 706 and 709 packages. Note that Form 843 cannot be e-filed. Check the instructions for Form 843 for where to mail. The presence of Form 843 in a return will not prevent the rest of the return from being e-filed.
Form 843 is a two-page form, and heres how to complete it: 1) Top Section Check the right box. 2) Name and ID Info. 3) Line 1 Tax period. 4) Line 2 Amount to be refunded or abated. 5) Line 3 Date(s) of payment. 6) Line 4 Type of tax. 7) Line 5 Type of return. 8) Line 6 IRC code section.
While the 843 form is short and simple, the process of requesting a penalty or refund itself can be complicated, since there are so many forms you can use to request abatement. Since each situation requires a different form, filing the wrong form could lead to unnecessary delays and frustration.
Mail Form 843 with attachments (in a separate envelope than your tax return) to: Department of the Treasury, Internal Revenue Service Center, Ogden, UT 84201-0038. The refund from the IRS can take up to 6 months.
Write a letter requesting reasonable cause abatement, or send Form 843, Claim for Refund and Request for Abatement. The IRS decision usually takes about three to four months.
