Continuation of pay (COP) is an Office of Workers Compensation Program (OWCP) entitlement that allows the continuation of an employees regular pay by the employing agency for a maximum of 45 days with no charge to sick or annual leave.
After the initial 45 days, payments decrease to two-thirds of the regular wage amount (three-quarters if the employee has dependents). Compensation continues at this rate for an indefinite length of time based on the extent of the injury and what continued supporting documents the worker can provide.
Provided that the claimant reported the injury on a form approved by OWCP within 30 days following the injury, his or her entitlement to COP must begin within 45 days of the date of injury, whether its use results from disability due to the original injury or the need for medical care.
543.41 Continuation of Regular Pay For most employees who sustain a traumatic injury, FECA provides that the employer must continue the employees regular pay during any periods of resulting disability up to a maximum of 45 calendar days (see 545.72 for explanation of eligibility for COP).
Typically, a worker must have been employed at least 6 months to claim cumulative mental stress injuries. More psychiatric stress cases involve expensive litigation, and costs of providing treatment, evaluation and compensation can be extremely high.
