CPS has 60 days after receiving the report to determine whether the report is indicated or unfounded.
You may not know, except by seeing changes in the child and family. Our laws require CPS to work under very strict confidentiality rules, for the protection of everybody involved. The workers cannot share information about the report.
This status means the county agency investigating your CPS case determined the child was abused or neglected. By law, you must receive written notification of this finding. If your CPS case is indicated in Pennsylvania, connect with a Montgomery criminal defense lawyer from McKenzie Law Firm, P.C. today.
Existing law provides for services to abused and neglected children and their families. The Child Protective Services goal is to keep the child in his/her own home when it is safe, and when the child is at risk, to develop an alternate plan as quickly as possible.
Generally, the initial investigation lasts 45 days. If the investigation extends beyond this period, the agency must notify the family, and document their justification for an extension past the initial 45 day period. At the conclusion of the investigation CPS will notify the parents in writing of their decision.
