In terms of the Act, the executor of the deceased estate is responsible for paying estate duty. In order to do so, the executor must complete an estate duty return which must be submitted to the Master together with the liquidation and distribution account, and a copy must be submitted to Sars.
This registration of a deceased estate can be done at a SARS branch or using eFiling. SARS issues a new number to the deceased estate which they link to the existing income tax reference number belonging to the deceased individual.
Estate duty is a type of death duty when an asset is transferred after the death of a person. Estate duty is levied on the assets left behind by the deceased and it is imposed on the deceaseds estate in its entirety. The executor is responsible for paying this estate tax to the government.
The executor will calculate the Estate Duty payable when preparing the liquidation and distribution account. The executor must complete the Estate Duty Return (Rev267) and must submit the return, together with the liquidation and distribution account to the Master of the High Court as well as to SARS.
Estate duty is calculated at 20% of the dutiable estate. For example, if Johns dutiable estate is R1million, the calculation is 20% times R1million. That is R200 000.
