The Uniform Construction Code (UCC) requires code officials to issue a Temporary Certificate of Occupancy (TCO) when all utilities are in place, and the building, or specified portions of a building, can be occupied without endangering the health and safety of the occupants (N.J.A.C. 5:23-2.23).
Temporary Certificates of Occupancy ( TCO ) are issued at the discretion of the Construction Official. All final inspections must be performed and inspectors must agree that the project is suitable for a TCO . The unfinished work must be listed on the TCO and the TCO will be issued with an expiration date.
A TCO allows occupancy of a structure prior to final approval by all developmental related Departments. Traditionally, a TCO has been approved for a Tenant/Owner to gain access to a commercial occupancy for stocking of inventory, staff training, installing, and testing of computer systems etc.
