A writ of garnishment acts to garnish all property of the debtor possessed by the garnishee, all property of the debtor over which the garnishee has control and all property of the debtor that is in the custody of the garnishee.
Wrongful wage garnishment can happen due to procedural errors, such as failing to follow the proper legal procedures or violating state or federal laws governing wage garnishment.
What do I do if I believe the property or money that was seized isnt allowed to be taken? If you think that we have garnished property or money that is exempt (protected by law) from garnishment you may submit a Challenge to Garnishment through Revenue Online or submit the Challenge to Garnishment form.
The following are the most commonly used statutes of limitations, but be sure to check Chapter 12 to make sure the limitation period has not changed: 1 year Garnishments (1 year from delivery of writ) 2 years Negligence for injury to person or damage to property.
There are two exemptions that apply to the debtors wages. The normal wage exemption protects 75 percent of a persons wages after required payroll taxes (ORS 18.385(1)). The minimum wage exemption requires that a person makes a minimum amount before their wages are subject to garnishment (ORS 18.385(2)).
