DAVIS-BACON ACT, AS AMENDED A wage determination is the listing of wage rates and fringe benefit rates for each classification of laborers and mechanics which the WHD Administrator has determined to be prevailing in a given area (usually a county) for a particular type of construction.

Wage Determinations are reviewed periodically, as new data become available. Most wage determinations are updated once a year.

What is the timeline for prevailing wage?

The prevailing wage determination sets the minimum wage that the employer must be willing to pay the employee, at the time that the employee becomes a legal permanent resident. Currently, DOL issues a prevailing wage determination in 6-8 months (10 months for union positions).

How often do prevailing wages change?

The prevailing wage survey must be conducted prior to paying a subminimum wage. It then must be reviewed and updated at least once a year - more frequently when a change in the prevailing wage has most likely occurred, such as when the FLSA minimum wage or a higher State minimum wage has been increased.

Under this new provision, such rates may be adjusted no more frequently than once every three years, and no sooner than three years after the date of the rates publication, continuing until the next survey results in a new general wage determination.
