How do I request parole in place? You will need to complete Form I-131, Application for Travel Document, and submit it (without fee) to your local USCIS office. You will also need to provide copies of documents that show you are eligible for parole in place (do not submit originals).
If you have any disqualifying criminal history, or otherwise constitute a threat to national security, public safety, or border security, as defined in the 2021 Guidelines for the Enforcement of Civil Immigration Law, USCIS, in our discretion, will deny your request for parole in place.
If you received a mandatory-minimum term as part of your sentence, then your parole eligibility is based on the mandatory-minimum term less jail credits only, provided the mandatory-minimum term is greater than one-third of your maximum sentence.
