The right of publicity is a property right, i.e.the right to control the commercial exploitation of a persons name or likeness. The right protects the economic interests in personality elements, e.g.likeness, name, and voice. It may be transferred and inherited, and it is actionable if it is infringed.
The right of publicity was first identified as such in a 1953 case called Haelen Laboratories vs. Topps Chewing Gum, Inc. In Haelen, the court pointed out the right of publicity was not based on protecting a persons privacy, but on preventing the unauthorized use of a persons name or likeness.
A person has the right to use his or her name, portrait, voice or other personal identity marks in a rational way. The right of publicity under paragraph (1) shall not be transferred.
What Is Right of Publicity? The right of publicity is an intellectual property right that protects against the misappropriation of a persons name, likeness, or other indicia of personal identitysuch as nickname, pseudonym, voice, signature, likeness, or photographfor commercial benefit.
A violation of this right occurs when an individuals name, likeness or identity has been misappropriated by another for commercial purposes. The victim in such a case is entitled to recover for the unauthorized economic gain by the tortfeasor.
