Your FERS annuity can be considered in a divorce settlement, so you could end up paying a portion of this retirement income to your ex-spouse. For an ex-spouse to receive annuity payments from FERS, it requires a court order to have the Office of Personnel Management (OPM) make these payments.
Federal Employees Health Benefits (FEHB): On the date of the divorce, the former spouses coverage is terminated. The FEHB program has a 31-day temporary extension of coverage at no cost. At the end of the 31-day period, your former spouse can enroll in TCC for up to 36 months after losing coverage.
A court order can apportion or divide a CSRS or FERS benefit as a result of a divorce, legal separation, or annulment of marriage. The court order must expressly direct OPM to pay a portion of the monthly CSRS or FERS benefits.
Divorced people can receive survivor benefits of 71.5 percent to 100 percent of the late former spouses benefit amount, depending on your age when you claim. In most cases, you still must have been married for 10 years. Your survivor benefits do not affect those paid to an exs widow or widower, and vice versa.
