Californias new probate law makes the process easier and allows for a smoother transition of the decedents estate to their successors. The law goes into effect in April 2025. Some key components of the new law are as follows: Allows for a simple transfer of primary residences of up to $750,000 from decedent to heirs.
A new California law tries to make it easier for families to inherit lower-value homes without probate. If a primary residence is valued at $750,000 or less, it can be transferred using a simplified court process. But heres the catch: The fair market value (not the equity) is what matters.
You must obtain the form used by the probate court in the county where the deceased was a resident. You can obtain it in person or by accessing your courts self-help center online and downloading the form there. Follow the instructions on the form to complete it.
Probate is required in California when estate value exceeds $208,850 (on or after April 1, 2025), $184,500 (after April 1, 2022 but before April 1, 2025) or $166,250 (before April 1, 2022).
