Involuntary admission begins when the Mental Health Act (MHA) Director or delegate of a designated facility completes Section 2 of Form 4.1 and lasts up to 48 hours. A Form 4.2 must be completed during this time to extend involuntary admission for up to one month.
The Form 11 certificate will state reasons why you are considered (deemed) to be not competent. A copy of the Form 11 certificate must be given to you. It must also be given to either your guardian or agent (if there is one) and, unless you object, your nearest relative.
Under the MHA, one admission certificate expires at the end of the 24 hours unless a second certificate has been issued by a second qualified health professional who has independently examined you and is of the opinion the criteria are met, and you should be detained in hospital involuntarily as a formal patient.
The Mental Health Act allows individuals with serious mental disorder to be involuntarily detained in a designated facility for treatment or to receive mandatory treatment in the community.
