An Affidavit of Consent is a legal document that you can use to agree to move forward with a no-fault divorce. In some states, its a required first step for this type of divorce, where both spouses agree that the other spouse isnt at faultin other words, neither spouse caused the divorce.
One is called a waiver of Notice of Intent to Request a Grounds Order and the other is a Waiver of Notice of Intent to Request a Divorce Decree. What these forms mean if you sign them are that you are giving up the 20 day notice required to let you know either a grounds order or decree will be entered.
A proof of service shall contain a statement of the date and manner of service and of the names of the persons served. Under 18 Pa. C.S. 4904 (unsworn falsification to authorities) a knowingly false proof of service constitutes a misdemeanor of the second degree.
(c) Mutual consent.-- (1) The court may grant a divorce where it is alleged that the marriage is irretrievably broken and 90 days have elapsed from the date of commencement of an action under this part and an affidavit has been filed by each of the parties evidencing that each of the parties consents to the divorce.
(3) In the case of an action for divorce under section 3301(d), an affidavit has been filed and no counter-affidavit has been filed or, if a counter-affidavit has been filed denying the affidavits averments, the court determines that the marriage is irretrievably broken and the parties have lived separate and apart
