New Law: Courts have now been empowered to direct child support payments into special needs trusts for children with disabilities. This ensures that financial support does not jeopardize the childs eligibility for public assistance programs like Medi-Cal or Supplemental Security Income (SSI).
In California, consistent failure to pay child support can result in a felony charge. This is when the parent who should be paying support owes more than $2,500 in back payments. If the total sum is less than that, there is still time for other solutions to be implemented before it docHubes this point.
In Mississippi for one child the non-custodial parent pays 14% of their adjusted gross income. For two children the non-custodial parent pays 20% of their adjusted gross income.
If, under the same circumstances, the child support payment is overdue for longer than 2 years, or the amount exceeds $10,000, the violation is a criminal felony, and convicted offenders face fines and up to 2 years in prison (See 18 U.S.C. 228(a)(3)).
Unlike many other legal matters, California sets no statute of limitations for collecting past-due child support. Theres no time limit on a parents ability to seek unpaid child support from the non-custodial parent, and the court can enforce child support obligations until the parent pays them in full.
