As of Jan. 1, 2025, California law mandates a written buyer-broker representation agreement for buyers brokers to receive a commission in real property sales. The new law applies to sales of all property types, including office, retail, industrial, multifamily and single-family properties.
A major change in 2025 affects rental payment history reporting. Landlords must now offer tenants the option to report positive rental payment history to at least one nationwide credit reporting agency. This new law is designed to help tenants build their credit.
Under Assembly Bill 2747, tenants of any residential property will receive the offer to report from their landlord. For tenants starting their lease on or after April 1, 2025, positive rental payment reporting will be done at the beginning of the tenancy and at least once a year afterward.
Under California civil code, tenants without leases maintain rights like limits on rent increases, proper notice before eviction, and requiring the landlord to maintain habitable living conditions. Be aware that without a lease, landlords only need to provide 30 days notice to increase rent or terminate tenancy.
As of January 1, 2025, California bill AB2493 mandates that landlords only charge a screening fee when they have available units for rent and have already determined an applicant meets their rental criteria.
