The Certificate of Status of Beneficial Owner for United States Tax Withholding and Reporting (Entities), a.k.a. Form W-8BEN-E, is used by a foreign person to establish beneficial ownership and foreign status, and avoid 30% withholding for U.S. taxes.
For example, if youre a nonresident who earns interest from U.S.-issued securities, you will need to file a W-8BEN. If youre a foreign business owner with income from entities based in the U.S., youll complete Form W-8BEN-E.
Failure to provide a Form W-8BEN when requested may lead to withholding at the foreign-person withholding rate of 30% or the backup withholding rate under section 3406.
Who Can File W-8 Forms? W-8 forms are filled out by foreign individuals or entities that lack U.S. citizenship or residency, but have worked in the U.S. or earned income in the U.S. This usually applies to foreign-domiciled businesses and non-resident aliens.
