The Labor Certification process, commonly referred to as PERM, is the process by which a U.S. employer sponsors an employees immigration. There are no jobs that cannot qualify for Labor Certification.
Program Overview. A permanent labor certification issued by the Department of Labor (DOL) allows an employer to hire a foreign worker to work permanently in the United States.
Section 11(a) of the FLSA authorizes representatives of the Department of Labor to investigate and gather data concerning wages, hours, and other employment practices; enter and inspect an employers premises and records; and question employees to determine whether any person has violated any provision of the FLSA.
PERM / labor certification is difficult, and the process will often last around 18 months. The Department of Labor (DOL) spends much of that time trying to locate any U.S. workers who meet the employers minimum requirements regarding education, experience, and training for the position.
