The Time Limit for Appeal The time limit for such an appeal in an intra-court is a maximum of 30 days. On the other hand, if an appeal has to be filed before the Supreme Court against the order of the High Court, it is known as an inter-court appeal. The time limit for such an appeal is a maximum of 90 days.
An appeal brief is an optional written document where the parties explain to the EEOC Office of Federal Operations why a federal agency or EEOC Administrative Judge made a mistake or decided the case correctly in an earlier decision.
You must submit your appeal brief no more than two months after you receive the Patent and Trademark Offices notice of appeal. If you requested a review of the rejection first, you must file your appeal brief no more than thirty days after receiving the panels decision. Do not forget to include the appropriate fees.
The usual period of time in which appellant must file his or her brief is 2 months from the date of the notice of appeal. The Office date of receipt of the notice of appeal (and not the date indicated on any Certificate of Mailing under 37 CFR 1.8 ) is the date from which this 2-month time period is measured.
