When the probate court appoints a personal representative, it issues a document called Letters. This document is proof of the personal representatives legal authority to collect and manage estate property. The personal representative is entitled to collect a reasonable fee for the work performed for the estate.
(b) Except where the will of the decedent authorizes to the contrary, a personal representative may not sell real property of the estate except as authorized pursuant to the procedure described in Section 62-3-1301, et seq.
Generally, a Personal Representative is entitled to a commission not to exceed 5% of the value of the personal property of the estate. This does not include the value of real estate, unless the real estate is sold by the Personal Representative as part of the administration of the estate.
South Carolina law sets forth a priority list of who may be appointed the personal representative, and its usually the surviving spouse or next of kin. Appointment is granted informally to someone who has priority under state law or formally with notice to all with higher priority.

(b) If the personal representative first knows of an estate creditor less than 28 days before the expiration of the time limit in subdivision (a), within 28 days after the personal representative first knows of the creditor.
