Alright this is what to do. If you sign up for Fastrak you can pre-date your account to before your violation. If you do this you will only have to pay the tolls and not the fines. Then cancel the Fastrak and return the transponder in a month or two, you will have $40 tied up for a couple of months but avoid the fines.
