Appeals FAQs. Who can request a NICS Appeal? Individuals who believe they have been erroneously denied or delayed a firearm transfer based on a match to a record returned by the NICS may request an appeal of their deny or delay decision. A delayed transaction will be purged from the NICS within 88 days from creation.
Prospective firearms buyers who receive a \u201cDenied\u201d status on their background checks may have a state or federal firearm prohibition. The denied individual may choose to pursue a challenge and/or apply to the Voluntary Appeal File.
How Long Does it Take? The process can take anywhere from 2 to 12 months, depending on whether you have already successfully appealed a wrongful firearm delay or denial through NICS. Much of the delay is due to the extremely high volume of appeal and VAF requests that NICS is currently processing.
The FBI's 2019 NICS Operations Report shows that 27% of denial appeals were overturned. There were 103,592 total federal denials in 2019, and 19,278 appeals filed.
