Local Sales and Use Tax Rates on Residential Energy The Tax Law provides that residential energy sources and services are exempt from the 4% New York State sales and use tax, and the ⅜% sales and use tax imposed in the Metropolitan Commuter Transportation District (MCTD), if applicable.
In December of 2021, Governor Kathy Hochul signed legislation that requires all heating oil sold for use in any building in the state of New York to contain at least 5% biodiesel by July 2022. A 5% biodiesel blending standard has been in place for New York City and Long Island since 2017.
Qualified biodiesel producers or blenders are eligible for an income tax credit of $1.00 per gallon of pure biodiesel (B100) or renewable diesel produced or used in the blending process. Re-blending of blended biodiesel does not qualify for the tax credit.
Fuel tax exemption: Purchases of wood or pellets for residential heating are exempt from state sales tax.
Biodiesel can be blended with petroleum heating oil and used at up to a 20% blend in any home heating system without making any modifications to the system. A 3% blend of biodiesel with 97% home heating oil is called B3. A 20% blend of biodiesel with 80% home heating oil is called B20.

New York also has a Motor Fuel Excise Tax (MFT) on gasoline and similar motor fuels that is imposed when motor fuel is first produced or imported or when diesel fuel is first sold or used in the State. Effective January 1, 2022, the MFT rate is 8 cents per gallon.
If the biodiesel was sold at retail, only the person that sold the fuel and placed it into the tank of the vehicle is eligible for the tax credit. The incentive is allowed as a credit against the taxpayers income tax liability.
How much is the credit? The credit is equal to one cent for each percent of biodiesel per gallon of bioheating fuel purchased before January 1, 2026. It may not exceed 20 cents per gallon.
Is Biofuel Cheaper than Oil? Biofuel costs roughly the same as conventional oil. It can also be slightly cheaper, depending upon circumstances. For example, some people have made their own biofuel blends if they have access to recycled cooking oil.
