To be eligible to claim the Empire State child credit, you must provide a valid Social Security number (SSN) or individual taxpayer identification number (ITIN) for you and for each child listed on your Form IT-213.
You can claim the Child Tax Credit by entering your children and other dependents on Form 1040, U.S. Individual Income Tax Return, and attaching a completed Schedule 8812, Credits for Qualifying Children and Other Dependents.
The Empire State child credit is a refundable credit available to full-year New York State residents who have at least one qualifying child. For tax years beginning on or after January 1, 2023, the credit includes qualifying children under four years of age but under 17, who meet income limitations.
NYS Empire State Child Credit Taxpayers who do not claim the federal credit can claim $100 for each child.
Families must have at least one qualifying child under 6 years old at the end of the tax year, must file a California state tax return, and meet the requirements of the CalEITC. Taxpayers do not need to have earned income to be eligible however, you must otherwise meet CalEITC and YCTC requirements.
